1. Introduction

Welcome to PAJR ("we," "our," or "us"), a Personal AI Journal & Response System that provides secure, intelligent, and encrypted communication across all your devices. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and PAJR regarding your use of our Service.

• Voice Recording: Voice message recording and transcription capabilities
• Device Management: Management of PAJR devices and connected hardware

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We do not guarantee that the Service will be available at all times or that it will be error-free.

6. User Responsibilities

As a user of the Service, you agree to:

• Provide accurate, current, and complete information during registration and keep it updated
• Maintain the security of your account credentials

7.4 Service Abuse

• Use the Service to compete with PAJR or to build a competing service
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity

8. Intellectual Property Rights

The Service, including all software, technology, designs, graphics, text, images, audio, video, and other content, is owned by PAJR or its licensors and is protected by copyright, trademark, patent, and other intellectual property laws. All rights not expressly granted to you are reserved by PAJR.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

PAJR uses artificial intelligence and machine learning services (provided by AWS Bedrock with Anthropic Claude) to provide features such as message composition, transcription, and response generation. These AI services are provided "as is" and may not always be accurate, complete, or appropriate.

10.2 AI Output Limitations

You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or inappropriate content
• AI outputs should be reviewed and verified before use or reliance
• AI services may not always understand context or nuance correctly
• AI outputs may reflect biases present in training data (though we use enterprise AI services with bias mitigation)
• You are responsible for all Content sent through the Service, including AI-assisted content

10.3 No Reliance on AI Outputs

You agree not to rely solely on AI-generated content for critical decisions, legal matters, medical advice, financial decisions, or other matters requiring professional judgment. AI outputs are tools to assist you, not replacements for human judgment.

11. Payment Terms

11.1 Fees

Certain features of the Service may require payment of fees. All fees are stated in U.S. dollars and are non-refundable unless otherwise required by law or as explicitly stated in our refund policy.

• You remain responsible for all fees incurred before termination
• Provisions of these Terms that by their nature should survive termination will survive

Upon account termination, we will delete your personal data within 30 days, except where we are required to retain it by law. Encrypted backups will be deleted according to our backup retention policies.

14. Limitation of Liability

14.1 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAJR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Loss or corruption of data
• Cost of substitute services
• Personal injury or property damage

14.2 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

16. Dispute Resolution

Before filing a claim, you agree to contact us to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within 60 days of your notice.

16.2 Binding Arbitration

If we cannot resolve a dispute informally, you and PAJR agree to resolve any disputes through binding arbitration rather than in court, except for:

• Small claims court actions
• Intellectual property disputes
• Disputes that qualify for injunctive relief

16.3 Class Action Waiver

You agree that disputes will be resolved individually and not as part of a class action, consolidated action, or representative proceeding.

17. Governing Law
